Terms of Service

1) Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of nomadapto ("nomadapto," "we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2) Who We Are

nomadapto is a marketplace that connects travelers, expats, and long-term visitors with local hosts offering furnished apartments in Medellin and other cities. We facilitate introductions between guests and hosts but are not a party to any rental agreement between them.

3) Eligibility

• You must be at least 18 years old and able to form a legally binding contract.
• You agree to comply with all applicable local laws, including tenancy, tax, and short-term rental regulations in your jurisdiction.

4) Accounts

• Provide accurate, current information and keep your credentials secure.
• You are responsible for all activity under your account.
• Notify us immediately of any unauthorized use or security incident.

5) The Service

• nomadapto provides a platform for hosts to list furnished apartments for rent or sale, and for guests to discover and inquire about them.
• Direct booking: Rental agreements, deposits, and payments between guests and hosts are negotiated and executed directly between those parties. nomadapto is not a landlord, lessor, or agent.
• Hosts are solely responsible for listing accuracy, property condition, compliance with local laws, guest communication, and the fulfillment of any rental agreement.
• Guests are solely responsible for complying with any rental agreement they enter into with a host, including timely payment, property care, and conduct during the stay.

6) Fees

• Rental listings: Free to create and publish.
• Sale listings: A one-time listing fee applies per listing (currently USD $100 for a 30-day listing). Fees are processed by Stripe and are non-refundable except as required by law.
• Credits: Hosts may purchase credit packs to unlock guest inquiries. Credits are non-refundable and non-transferable.
• Optional features: Certain features (e.g., trust badges, payment processing via Stripe Connect) may carry additional fees, clearly disclosed before purchase.
• Fees may change from time to time. We will provide reasonable notice of material changes.

7) Your Content

• You retain ownership of content you post (listings, photos, descriptions, messages, profile information).
• You grant nomadapto a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as necessary to operate the Service.
• You represent that you have all rights necessary to post your content and that it does not infringe any third party's rights or violate applicable law.

8) Prohibited Uses

• Illegal, fraudulent, or deceptive activity, including false listings or misrepresentation.
• Discriminating against guests or hosts on the basis of race, religion, national origin, disability, sex, gender identity, sexual orientation, age, or any other protected class.
• Listing properties you do not have the legal right to rent or sell.
• Circumventing the Service to avoid fees, including communicating off-platform to evade credit costs.
• Scraping, bulk data extraction, or disrupting the Service.

9) Service Availability; Changes

We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide notice of material changes affecting existing users.

10) Suspension & Termination

• We may suspend or terminate your access for violations of these Terms, non-payment of fees, or risk of harm to the Service or other users.
• You may terminate your account at any time by contacting us.
• Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnities) will survive.

11) Disclaimers

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation. We do not verify the identity of hosts or guests, the accuracy of listings, or the condition of properties. You use the Service at your own risk.

12) Limitation of Liability

To the maximum extent permitted by law, nomadapto and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from or related to your use of the Service, any rental agreement, or any interaction with other users. Our total liability for any claim relating to the Service is limited to the amounts you paid to nomadapto in the three (3) months preceding the event giving rise to the claim.

13) Indemnification

You will defend, indemnify, and hold harmless nomadapto from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your rental agreements with other users, or your violation of these Terms or applicable law.

14) Privacy

Our collection and use of personal information is described in our Privacy Policy.

15) Governing Law

These Terms are governed by the laws of [Your jurisdiction], without regard to conflict of laws rules. Disputes will be resolved in the courts located in that jurisdiction, and you consent to such jurisdiction and venue.

16) Changes to These Terms

We may update these Terms from time to time. If a change is material, we will provide notice (for example, by email or in-app notification). Your continued use of the Service after changes become effective constitutes acceptance.
